1. Overview & Who We Are

Scuber.pro is an AI-first home improvement RFQ (Request for Quote) marketplace focused on front-yard landscaping during a limited US-only pilot. We help homeowners generate AI concept images from their own uploaded photos and route qualified requests for quotes to landscape professionals who contact the homeowner directly.

Scuber is based in Dallas, Texas and will be incorporated as Scuber, LLC.

2. Scope of this Policy (US Pilot Only)

This Privacy Policy applies to the Scuber.pro pilot operated in the United States. It covers our website and pilot workflows used by US homeowners to generate concepts and request quotes. It does not cover the separate Scuber Pro portal or commercial transactions made by Landscape Professionals, which are governed by the Scuber Pro Privacy Policy.

  • Non-US Users: This policy does not apply to non-US users.

3. Personal Data We Collect

Directly from you

  • Contact details: Name, email, phone number.
  • Property context: Street address and related location details necessary to match with local pros.
  • Uploaded photos: Front-yard images you upload to generate concept images.
  • "Chakuso" Content: The combination of your uploaded "Before" photo and the AI-generated "Inspirational" image, if you choose to save or share it.
  • Preferences: Style or service preferences that help tailor concepts and match you to pros.
  • Communications: Messages you send to us and your choices about notifications.
  • Smart Detection: We use on-device processing to help you avoid uploading photos containing people. This technology detects the presence of a person generally (object detection) but does not use facial recognition or biometric scanning to identify individuals.

Automatically

  • Geolocation & Verification: We collect precise location data to verify your property location and match you with local contractors who service your specific area.
  • Device and usage data: IP address, device type, browser, pages viewed, timestamps, referral pages.
  • Cookies and SDK events: Session identifiers, performance metrics, crash logs, A/B testing variants.

Sensitive or potentially sensitive elements

  • Incidental Details: Images may reveal house numbers, parked vehicles, faces, or other incidental details.
  • No Facial Recognition: We do not use facial recognition technology (FRT) or biometric scanning to identify individuals in your photos. Any faces detected by our AI are processed only as incidental objects within the image for the purpose of generating landscape concepts.

4. How We Use Personal Data

A. Service Delivery & Lead Generation (Selling Leads)

  • Generate Concepts: We use your uploaded front-yard photo to generate concept images personalized to your property.
  • Route Your Request: We route your request to relevant landscape professionals.
  • The "Sale" of Leads: Scuber operates as a lead-generation marketplace. When you request a quote, we sell or disclose your contact information, project details, address, and images to third-party Landscape Professionals so they can contact you.
  • Intentional Direction: By submitting a quote request, you intentionally direct Scuber to share your personal information with these professionals. This exchange is the core service you are requesting.

B. AI Model Training & Improvement

  • Improving Our Technology: We use your uploaded photos and generated concept images to analyze, train, and improve our AI models, prompts, and features. This helps us generate better landscaping ideas for future users.
  • De-identification: Where reasonably possible, we de-identify data before using it for model training.

C. The "Chakuso" (Public Sharing)

  • Sharing Your Vision: If you choose to publish a "Chakuso" (your Before/After images) to our gallery or social features, you acknowledge that these images will be publicly visible.
  • Your Responsibility: You are responsible for ensuring your "Before" photo does not contain private details (e.g., visible neighbors, license plates, or people) before you choose to share it publicly.

D. Communications

  • Status Updates: We send email or SMS about quote status, scheduling, reminders, and pilot updates you request.
  • Opt-out: You can opt out of non-transactional emails or SMS at any time.

E. AI Accuracy & Feasibility (Disclaimer)

  • Generated Concepts: Our Service uses artificial intelligence to generate landscape concepts based on your photos. Please note that these images are computer-generated predictions for inspirational purposes only. They may contain "hallucinations" (visual artifacts, non-existent objects, or physical impossibilities) and may not be factually accurate, structurally sound, or horticulturally viable. You should not rely on these generated images as architectural plans, construction documents, or accurate representations of property dimensions.

5. Legal Bases / Lawful Grounds (US framing)

  • Contract: To provide the pilot services you request, including concept generation and routing leads to pros.
  • Legitimate Interests: Quality, safety, security, analytics, and product improvement (including model training).
  • Consent: Optional marketing communications and cookies where required.
  • Legal Obligation: To comply with applicable law and respond to lawful requests.

6. Sharing & Disclosure

Landscape Professionals

To enable quotes, we disclose to selected pros: your name, contact details, service location, the uploaded photo(s), the concept image you selected, and relevant preference notes.

  • Independent Third Parties: Landscape Professionals are independent business entities. They are not employees, agents, or representatives of Scuber.
  • No Liability for Professional Conduct: Scuber acts solely as a venue to connect parties. We generally do not guarantee that a Professional will contact you, agree to quote your project, or accept the job. Scuber is not responsible or liable for the Professional's conduct, responsiveness, quality of work, or any disputes that arise after we have passed your information to them.
  • Data Control: Once your data is passed to a Professional, it is governed by their privacy policy and retention practices, not ours.

Service Providers

We use vendors for cloud hosting, storage, analytics, crash reporting, and AI inference. They may access personal data only to provide contracted services.

Corporate Transactions & Law Enforcement

We may disclose information if we undergo a merger or acquisition, or when required by law to protect safety and security.

7. Data Retention

We retain data only as long as needed for the pilot and for the purposes described.

8. International Data Transfers

Processing is primarily US-based. When we transfer data internationally to vendors, we use appropriate safeguards such as contractual protections.

Unauthorized International Access: The Service is hosted in the United States and is intended solely for users located within the United States. We do not knowingly offer goods or services to individuals outside the U.S.

If you choose to access the Service, upload photos, or generate concepts from outside the United States (including from the European Economic Area, UK, or Switzerland), you do so at your own risk. You acknowledge that you are transferring your personal information to the United States for storage and processing. By using the Service, you specifically consent to the transfer of your information to the U.S. and the application of U.S. laws, which may provide less protection than the laws of your jurisdiction.

9. Your Rights & Choices (US State Law)

You have privacy rights under laws in several US states.

  • Access, Correct, Delete: You may request to access, fix, or delete your personal data.
  • Opt Out of "Sale": You may opt out of the sale of your personal data. Warning: As our service is connecting you to pros, opting out of the sale of your contact info will prevent us from fulfilling your request for a quote.
  • Right to Appeal: If we decline to take action on your request, you may appeal our decision by emailing us.
  • Non-discrimination: We will not discriminate against you for exercising your privacy rights.

10. Automated Decision-Making & Profiling (Lead Routing)

We use automated systems to route your request to relevant landscape professionals based on location and service type. We do not use automated decisions to deny services to consumers.

11. Security

We use technical and organizational safeguards designed to protect your personal data, including encryption in transit. No system is perfectly secure.

12. Children & Age Limits

The pilot is not intended for minors. To use Scuber.pro, you must be 18 or older. We do not knowingly collect data from children under 13.

13. Cookies & Similar Technologies

We use cookies and SDKs to operate and improve the pilot.

  • Categories: Essential, Analytics, A/B testing, and Advertising.
  • Global Privacy Control (GPC): We honor Global Privacy Control (GPC) signals where required by law.

15. How to Exercise Your Rights

16. Changes to This Policy

We may update this Policy as needed. We will post updates on the website and revise the effective date.

17. State-Specific Disclosures

Texas (TDPSA)

Scuber is based in Texas. We comply with the Texas Data Privacy and Security Act (TDPSA). Although we may qualify for certain small business exemptions, we voluntarily afford Texas residents the rights described in Section 9, including the right to appeal a refusal to take action on a request.

California (CPRA)

  • Sale/Sharing: We "sell" personal information (contact details) to Landscape Professionals to fulfill your service request. We do not sell data to data brokers. You may opt out at any time, but this may limit our ability to connect you with pros.
  • Sensitive Personal Information: We do not use SPI for purposes requiring a "Limit Use" link.

Colorado, Connecticut, Virginia, Utah

Residents have rights to access, delete, correct, portability, and opt out of sale, targeted advertising, and profiling.

18. Facebook User Data Deletion Instructions

If you signed in to Scuber.pro using Facebook and would like your data deleted, you can request deletion directly from within Scuber.pro.

  1. Open the Scuber.pro webapp (go to scuber.pro on your mobile device browser).
  2. Log into your account.
  3. Go to Settings.
  4. Tap Delete Account.
  5. Follow the confirmation steps to permanently delete your account and associated personal data from Scuber.pro.

You may also remove Scuber.pro from your Facebook account by going to Facebook Settings & Privacy > Settings > Apps and Websites > Scuber.pro > Remove.
